LIST OF BENEFITS
- ALL WEEKLY CURB SIDE GARBAGE PICKED UP FROM EACH HOME.
PLUS THE FOLLOWING:
- Maintenance and installation of all custom designed and built mail
boxes and address signs.
- Weekly pick-up of garbage from common parks and nature trail receptacles.
- Maintenance of entry monuments.
- Maintenance of nature trails.
- Maintenance of all islands in street loop designs.
- Maintenance and set-up of all street/traffic signs.
- Maintenance of all street signs and the monthly electric fees.
- Maintenance landscaping of all common park grounds.
- Maintain all wild flowers.
- Grass mowing and snow plowing of all nature trails.
- Special events and holiday planning of decorations and lighting.
- Taxes and insurance on all common grounds.
- Maintenance of ponds, fountains, and irrigation systems.
- Maintenance of all rest areas and inspiration areas.
- Maintenance of all keystone and boulder walls bordering roadways.
- Funding for administration, maintenance and management staff.
All the above service for the proposal fee of $48.00 per month.
These fees are payable in advance on a quarterly base ($144.00) payments
SUMMARY OF DECLARATION OF COVENANTS,
CONDITIONS AND RESTRICTIONS FOR THE WOODLANDS OF LIVONIA
PURPOSE
All of the lots in The Woodlands of Livonia are benefited by and subject
to certain Declarations of Covenants, Conditions and Restrictions. The
purpose of the Declarations is to create a community of compatible and
complimentary single family residential homes for the benefit of the
residents of The Woodlands of Livonia and to protect the value and desirability
of The Woodlands of Livonia.
HOMEOWNERS ASSOCIATION
Under the Declarations, a nonprofit homeowners association has been
created known as "The Woodlands of Livonia Homeowners Association".
There are two classes of membership, Class A and Class B members. Class
A members are all of the owners except Zimwood, LLC. Zimwood, LLC is
a Class B member. Class A members are entitled to one vote for each
Lot. When more than one person is an owner of a Lot, all such persons
shall be members but the owners of the Lot shall collectively be entitled
to only one vote for the Lot. Zimwood, LLC is entitled to three votes
for each Lot owned. Class B membership shall cease and become converted
to Class A membership when the total votes in Class A equal the total
votes in Class B or December 31, 2003,
The Association is operated by a Board of Directors that are elected
by the members and such other committees as are established including
an Architectural Control Committee.
COMMON BENEFITS
The Association has the ownership and/or easement -rights to certain
common properties including natural areas, walking paths, street lights,
entry monuments and boulevard areas. Each owner of a Lot has certain
rights to use common property in The Woodlands including the walkways
that have been established and maintained by the Association. The use
and maintenance of the walkways is under the direction of the Association.
The Association also provides certain services such as rubbish pick-up,
mail boxes, maintenance of common areas and architectural approval and
regulation.
ASSESSMENT
The costs incurred by the Association to promote the recreation, health,
safety and welfare of the residents and owners of The Woodlands are
paid through an assessment against each Lot owned within The Woodlands.
In this regard, the Association will annually prepare a budget and notify
the owners of the annual assessment, the procedures for payment, the
due date and other matters relating to the assessment. The Association
has certain remedies available to it in the event the assessment is
not paid.
ARCHITECTURAL SPECIFICATIONS
The construction of any building, fence, wall, patio, or other structure
on a Lot in The Woodlands must be approved by the Architectural Control
Committee and be in conformity with the Declarations as well as the
local building and zoning laws.
The Declarations contain certain structural and other specifications.
The purpose of those specifications is to assure certain quality standards.
One specification requires that all houses must have a minimum
cost, including the Lot and landscaping of the greater of $250,000.00
or five times the sale price of the Lot by Zimwood. The specifications
also regulate certain matters such as garages, accessory buildings,
antennas, mail boxes, parking of motor vehicles and tree removal. The
initial Architectural Control Committee has been appointed by Zimwood.

of Covenants, Conditions, and Restrictions, together with the Articles
and Bylaws of the Homeowners Association are the controlling documents
for The Woodlands of Livonia.

Prior to closing on a Lot or home purchase, all buyers must meet with
a representative of Zimwood, LLC to review the Declarations and the
operation of the Association. The buyers will be asked to acknowledge
that they have read the Declarations and are familiar with them and
